Update RE: Outstanding Dues Collection

As mentioned in a previous post, I met with a lawyer to discuss the issues surrounding our dues collection. The discussion included Liens, Judgement Liens and Foreclosures, along with the cost to homeowners. As a board we have decided to retain this lawyer at the cost of $1,000.00 which will be divided and added to the dues of the homeowners with delinquent balances, per our bylaws.

The HOA will be turning over all information about delinquencies to the lawyer to pursue legal action. All money used for legal action will be passed on to the homeowner. According to West Virginia law, all homeowners entered a contractual obligation as part of the deed when they purchased the property to pay their dues to the HOA.

The cost for the lawyer’s services is listed in the letter below, and I have included the article in our bylaws stating that the cost for the retrieval of collections is the financial responsibility of the homeowner. Additionally, it is important to note that each retainer is for each homeowner, so if we move to foreclose on a delinquent property, then that charge to the owner begins at $3500.00 and rises from there. This is in addition to their outstanding dues.

We as a board have exhausted all possibilities and regret that it has come to this, but it is not right for only some in the subdivision to pay for the roads, drains, and other amenities we all use and benefit from. ARTICLE 28: Lawyer Fees and Legal Fees Recovery Judgements

FPHA is entitled to collect all attorney fees from the homeowner that is involved in any

Delinquencies, Non-Payment, Servitude, Foreclosure, Collections or any other matter

which may arise, that would require FPHA to seek council through any attorney.

Good evening.

It was nice to meet with you recently concerning the needs of your Homeowners Association.

I am providing the below attorney fee pricing per your request:

If the Association would like to place a retainer for general assistance with letters to homeowners, Notices of Liens, etc., the retainer would be $1000.

If you are wanting to pursue a civil action to obtain a judgment, the retainer would be $2,000.

If you would like to pursue an action to foreclose, I would first need to review your covenants and by-laws in accordance with WV law, and conduct a title examination, but the retainer fee would be $3,500.

These retainers would be billed against at my hourly rate of $300, with my paralegal's time billed at an hourly rate of $125.

June 2024 - Update Regardiung: Dues, Painting & Roadwork

Hello all Homeowners ,

Just a follow up on a board meeting we had to set the ball rolling on events taking place in the subdivision and with the subdivision.

June 1st has past and all dues after June 1st are now $400.00. The increase has been added to the accounts and a new invoice reflecting the new amount will be sent. Liens will be placed on any and everyone with dues a year or more in the past, along with the $50 filing fees. ALL DUES that are more than one year will be handled by the lawyers and the court system in regards to the code 36B that we shared to all Homeowners to show the process we must adhere to by law. There is an appointment very soon to discuss our next steps. Please remember all legal cost will go back to the Homeowners, we as a subdivision can not take on this expense as stated in our by laws.

The curbs will be repainted this year and the signs will be redone for clear visibility to all.

Road work section have been identified and that process will start soon also.

RE: 2024 HOA Dues - June 1

On June 1st we will be adding $50 to all unpaid dues. Those of you that have paid thank you . All Dues that are over 1 year old will get an additional $50 plus a lien placed on the property in June. We sent out certified mail to those past due and some were accepted and some did not sign to get the mail. It was info on the foreclosure procedure and the rights of HOAs to proceed under the WV Law. Along with the lien that is already place and an invoice of outstand dues. We have tried everything in our power to help and collect these dues and that was our last attempt before turning this over to proper people where all expenses go to collect are added to the homeowners per the by laws..

Update Regarding Collection Process - 3.20.24

Attention Homeowners:

URGENT! It is to the benefit of the entire HOA to read the following. Effective April 22, 2024, in keeping with WV Code 36B-3-115-116, we will be moving forward with foreclosure procedures on properties within the subdivision that are delinquent in their annual dues. Your Board has voted to begin with the highest unpaid properties first. Please read the following attachments carefully and contact us with any questions you may have regarding this process.

Concrete Work Starting This Week 7.21.23

Shamblin Stone will be starting road repair efforts this Friday and the areas they will be focusing on have been marked with orange spray paint throughout the subdivision.

If you see any orange markings in front of your driveway, we ask that you please utilize the on-street parking and allow for enough room for the equipment trucks to do their job. They did not specify which areas they will be starting on but if you see them out, please feel free to politely ask them for an estimate regarding the amount of time the repairs will be ongoing around your area so you can plan accordingly.

We appreciate everyone’s patience and cooperation as the roadwork is being completed and we ask that you do not disturb any street cones when they are deployed.

Notice will be placed in WV Gazette-Mail several days this week, plus Bridge Church FB page and Town of Poca FB page. Looks like the weather is going to be great.

If you have any unsold items that you would like to donate, The Bridge Church maintains a community pantry for those in need in our area. Items they can use are furniture, kitchen items, linens, clothing, etc. (No flowers, trinkets, or knick-knacks.)
